Testing Terms of Service

Version: 2026-08-07-testing-draft-1 · Effective for invited testing: August 7, 2026

Legal-review draft: These terms support controlled testing and have not yet been reviewed by Kansas counsel. Do not treat this draft as launch-ready legal advice.

1. Agreement and eligibility

These Terms govern access to the Trail Connector website, mobile application, administration tools, and related services (the “Platform”). By creating an account or continuing after an updated version is presented, you agree to these Terms and acknowledge the Privacy Policy. You must be at least 18 years old and legally capable of entering this agreement. Testing is invitation-only until Trail Connector announces otherwise.

2. A community connection platform

Trail Connector helps people communicate about off-road assistance and trail companionship. Trail Connector is not an emergency dispatcher, law-enforcement agency, towing company, roadside-assistance provider, recovery operator, transportation carrier, or insurer. Trail Connector does not direct, supervise, employ, or control community helpers merely because they use the Platform.

If anyone is in immediate danger, contact 911 or the appropriate local emergency service. Do not rely on the Platform where delay could threaten life, health, property, or public safety.

3. No guaranteed response or outcome

A request may receive no response. A response does not promise arrival, assistance, equipment, skill, safety, or a successful or damage-free result. Conditions can change quickly, especially where weather, terrain, fire, water, traffic, mechanical failure, communications loss, or limited access are involved.

4. Your decisions and assumption of ordinary off-road risk

You remain responsible for deciding whether to request, offer, accept, continue, or end an interaction. Inspect the situation, communicate limitations, use appropriate recovery points and rated equipment, follow manufacturer guidance, obey closures and laws, and stop when conditions are unsafe. Each participant is responsible for their own vehicle, equipment, passengers, conduct, and decisions.

5. Verification labels have limited meaning

A verification label means only what it specifically says. Email verification indicates control of an email address. Phone verification indicates completion of the stated phone process. An administrative identity review reflects only the review actually performed. Unless expressly labeled as a verified professional provider, these signals do not establish training, licensing, insurance, criminal history, character, ownership, mechanical fitness, recovery competence, or suitability for a particular situation.

6. Accounts and security

Provide accurate account information, keep credentials private, use only your own account, and promptly report suspected unauthorized access. You are responsible for activity conducted through your account unless prohibited by law. Trail Connector may require contact verification, additional review, or updated acceptance before enabling particular functions.

7. Location, photos, and communications

The Platform uses location to match requests and available helpers. Approximate request locations may be visible during matching. Exact request coordinates are released through the accepted-response workflow. Helper locations are used for private matching and anonymous nearby counts, not a public helper map. Messages, photos, reports, and location events may be retained to operate the incident, investigate safety concerns, prevent abuse, and satisfy legal obligations. Avoid submitting information you do not have permission to share.

8. Community conduct

Follow the Community Guidelines. Do not harass, threaten, discriminate, impersonate, defraud, stalk, exploit a vulnerable person, submit deceptive requests, interfere with another user’s vehicle or property without permission, encourage unsafe conduct, evade enforcement, or use the Platform for unlawful activity. Participants may decline or leave an interaction at any time.

9. Helper and professional roles

Community helpers must accept the separate Helper Agreement. Helper approval is not employment or authorization to represent Trail Connector. Professional-provider features, paid placement, dispatch, fees, or transactions will require additional terms before activation. No current label should be interpreted as a promise that commercial insurance applies.

10. User content

You retain ownership of content you submit. You grant Trail Connector a nonexclusive, worldwide, royalty-free license to host, reproduce, process, display, and share that content only as reasonably necessary to operate, secure, improve, and administer the Platform and its safety workflows. You represent that you have the right to provide the content.

11. Suspension and termination

Trail Connector may limit, suspend, or deactivate access to protect users, investigate reports, comply with law, address security risks, or enforce these Terms. During testing, features may change or stop without notice. Users may request account deactivation or deletion, subject to retention needed for active incidents, safety records, fraud prevention, legal obligations, and dispute resolution.

12. Disclaimers and allocation of risk

To the fullest extent permitted by law, the Platform is provided “as is” and “as available,” without warranties of availability, accuracy, fitness for a particular purpose, noninfringement, safety, or results. Trail Connector does not warrant the conduct, statements, vehicles, equipment, location, availability, or qualifications of users. Limitations of liability, indemnity, insurance treatment, and any waiver language must be reviewed and finalized by Kansas counsel before public launch.

13. Governing law and disputes

This testing draft is intended to be governed by Kansas law, without regard to conflict-of-law rules. The final forum, informal-resolution process, arbitration position, jury-trial language, class-action treatment, and any applicable exceptions are intentionally reserved for legal review rather than guessed here.

14. Changes

Trail Connector may revise these Terms. When a material change is made, the Platform may require affirmative acceptance of the new version before continued use. The acceptance record identifies the version and time accepted.

15. Contact during testing

Invited testers should contact the test coordinator who provided access. A permanent legal and privacy contact address will be established before broader availability.
